In the third portion of FSMA Fridays: Everything You've Wanted To Know About FSMA, But Were Afraid To Ask, Barbara Levin of SafetyChain and Dr. David Acheson of the Acheson Group continued their question and answer with members of the food industry around the most-pressing concerns of the Food Safety Modernization Act. Here, in part four of the series, the duo continues the conversation by answering questions from the webinar’s live audience.
Barbara: This question is from Moe. How much time will the government give for FSMA implementation?
David: Another good question and the great legal answer is it depends. But, it’s somewhat prescriptive. I say it depends — and it’s varying a little bit between the rules, and we’ll get clarity when we have the final rules — but the way it seems to be heading is that if you are a very small company, and the FDA seems to be defining very small company differently, with the different rules, but they’re doing that based on a dollar amount of FSMA. It’s in the range of $1 million-ish. If you’re a $1 million company or less, you would be considered very small, for some of the rules. Other rules, the dollar amount is a little higher. But it’s in that range.
